Overview

Welcome to Varevo. The terms “Varevo,” “we,” “us,” and “our” refer to Varevo. We operate this website, online store, and related content, features, tools, products, and services (collectively, the “Services”). Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer the Services to you.

These Terms of Service (“Terms”) govern your access to and use of the Services. They work together with our Privacy Policy, Return and Refund Policy, and Shipping Policy, each of which is available through the links in our website footer and is incorporated into these Terms by reference.

Please read these Terms carefully. By accessing the Services, browsing the website, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Services.

Nothing in these Terms limits any consumer right or remedy that cannot legally be waived or limited.

Section 1 - Eligibility, Access, And Accounts

By using the Services, you represent that you are at least the age of majority in your state, province, or country of residence, or that you are using the Services with the permission and supervision of a parent or legal guardian.

You may be required to provide information such as your name, email address, phone number, billing information, payment information, and shipping address. You agree that all information you provide is accurate, current, and complete and that you are authorized to provide it.

You are responsible for protecting your account credentials and for activity that occurs through your account. Notify us promptly at support@varevo.co if you believe your account or payment information has been used without authorization.

We may restrict, suspend, or terminate access to the Services when reasonably necessary to protect the store, customers, Shopify, service providers, or other parties from fraud, misuse, unlawful activity, security threats, or violations of these Terms.

Section 2 - Products And Product Information

We make reasonable efforts to display and describe our products accurately. However, product colors and appearance may vary because of lighting, photography, screen settings, manufacturing tolerances, packaging updates, and other factors.

Dimensions, capacities, weights, delivery estimates, compatibility statements, and similar product details may be approximate unless expressly stated otherwise. Minor variations that do not materially affect the product’s intended use do not necessarily constitute a defect.

Product descriptions, prices, availability, features, and specifications may be updated without notice. We may discontinue products, limit quantities, or restrict sales to certain customers, locations, or jurisdictions.

Products must be used only for their intended purpose and in accordance with all instructions, warnings, quick-start guides, and product-page information provided with or for the product. You are responsible for inspecting a product before use and discontinuing use if it appears damaged, unsafe, unusually hot, electrically damaged, or otherwise defective.

For powered products, use only compatible cables, adapters, and power sources. Unless a product listing expressly states otherwise, accessories such as charging or power cables, adapters, and external power sources are not included.

Do not use products in a manner that is unlawful, unsafe, inconsistent with provided instructions, or reasonably likely to cause injury or property damage. These use requirements do not limit any rights you may have regarding a defective or misdescribed product.

Section 3 - Orders And Order Acceptance

Submitting an order is an offer to purchase. Receipt of an order confirmation does not prevent us from declining or canceling an order before fulfillment for reasons including:

  • Product unavailability
  • Incorrect pricing or product information
  • Payment or fraud concerns
  • Suspected resale, abuse, or unauthorized activity
  • An undeliverable or incomplete address
  • Legal or regulatory restrictions; or
  • An error affecting the order.

If we cancel an order after payment has been collected, we will issue a refund to the original payment method for the canceled amount.

Please review your order carefully before submitting it. Contact support@varevo.co immediately if you need to request a cancellation or address change. We cannot guarantee changes after an order has entered processing or fulfillment.

We may limit or cancel quantities that appear to be placed by dealers, resellers, distributors, or other commercial purchasers. Products are offered primarily for personal and household use unless we agree otherwise in writing.

Section 4 - Prices, Payments, Taxes, And Promotions

Prices, discounts, promotions, and product availability may change without notice. The price charged is the price shown at checkout when the order is submitted, subject to correction of clear errors.

Unless stated otherwise, displayed product prices do not include applicable taxes, duties, import charges, shipping, or other fees that may be calculated at checkout or imposed by government authorities.

You agree to provide accurate and complete payment and billing information and represent that you are authorized to use the selected payment method. You authorize us and our payment providers to charge the amounts shown at checkout.

Promotions, free gifts, bundle discounts, quantity discounts, coupon codes, and other offers may be subject to separate conditions. Unless expressly allowed:

  • Offers cannot be combined
  • Free gifts have no cash value
  • A qualifying free gift must be returned when the qualifying purchase is returned in full; and
  • If only part of a qualifying bundle is returned, the refund may be adjusted to reflect the price that would have applied to the items kept, to the extent permitted by law.

We may cancel, correct, or limit a promotion when it is affected by a technical error, pricing error, misuse, unauthorized duplication, or fraud. This does not affect completed purchases except as permitted by applicable law.

Section 5 - Shipping And Delivery

Order processing, delivery estimates, tracking practices, international shipping information, and multiple-package information are described in our Shipping Policy.

All delivery dates are estimates unless we expressly state that a date is guaranteed. Delays may occur because of carrier disruptions, severe weather, customs processing, high-volume periods, holidays, supply interruptions, incorrect delivery information, or other circumstances outside our reasonable control.

We will comply with applicable law concerning shipment timing. If we cannot ship within the time stated at the time of purchase, we will provide any notice, consent option, cancellation option, or refund required by applicable law.

Orders containing multiple items may be fulfilled by different partners, shipped in separate packages, assigned different tracking numbers, and delivered on different dates.

You are responsible for providing a complete and accurate shipping address. Contact us promptly if you notice an error. We cannot guarantee that an address can be changed after processing begins. Additional costs caused by an incorrect or incomplete address may be the customer’s responsibility when permitted by law.

If tracking shows delivery but you cannot locate the package, or if an order appears lost or arrives damaged, contact support@varevo.co promptly. We may request photographs, video, carrier documentation, identity verification, or a signed statement as reasonably necessary to investigate the claim.

Nothing in this section limits rights or remedies that cannot legally be waived.

Section 6 - Returns, Refunds, And Exchanges

Returns, refunds, exchanges, damaged-item claims, and cancellations are governed by our Return and Refund Policy.

All returns require prior authorization. Before sending any product, contact support@varevo.co and follow the return instructions we provide.

Return destinations may vary by product and fulfillment partner. The business address shown in our Contact Information, Privacy Policy, Terms, footer, or other general business information is not a customer return facility unless we specifically authorize that address for a particular return.

Do not send products to our general business address without written authorization. Unauthorized returns may be refused, delayed, lost, or ineligible for reimbursement to the extent permitted by law.

If a return is approved, we will provide the applicable instructions and, when appropriate, a return label or return address. Products from the same order may require separate return instructions or destinations.

Refunds are generally issued to the original payment method after the approved return is received and inspected, unless we approve a refund without requiring a return or applicable law requires a different process.

Section 7 - Third-Party Services, Tools, And Links

The Services may include tools, payment services, review services, fulfillment services, tracking services, applications, content, or links provided by third parties.

Third-party services are governed by their own terms and privacy practices. We do not control every aspect of those services and are not responsible for third-party websites, content, policies, or services except to the extent responsibility cannot legally be excluded.

Your use of an optional third-party tool is at your own discretion. Review the third party’s terms before using it or submitting information.

Section 8 - Relationship With Shopify

Varevo’s online store is powered by Shopify. Purchases made from our store are transactions between you and Varevo, not between you and Shopify.

Shopify provides ecommerce infrastructure and may process information or provide related services, but Shopify is not the seller of Varevo products and is not responsible for fulfilling Varevo orders, handling Varevo product claims, or resolving disputes between you and Varevo.

To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising solely from the purchase, fulfillment, condition, or use of products sold by Varevo. This release does not apply where such a release is prohibited by law or where a claim arises from Shopify’s own conduct.

Section 9 - Privacy

Our collection, use, disclosure, and retention of personal information are governed by our Privacy Policy.

Because the Services are hosted by Shopify, information you submit may be collected, processed, transferred, or stored by Shopify and by other service providers that help us operate the store, process payments, prevent fraud, fulfill orders, provide customer support, send communications, analyze performance, or comply with legal obligations.

By using the Services, you acknowledge that you have reviewed our Privacy Policy. Your use of certain Shopify services may also be subject to Shopify’s privacy notices.

Section 10 - Intellectual Property

The Services and their content—including our names, logos, product names, designs, photographs, videos, graphics, text, page layouts, and other materials—are owned by or licensed to Varevo and may be protected by copyright, trademark, trade dress, and other laws.

We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Services for lawful personal and noncommercial purposes.

Without prior written permission, you may not:

  • Reproduce, republish, distribute, sell, license, or commercially exploit our content
  • Remove proprietary notices
  • Use our names, logos, images, or product content in a way that suggests affiliation or endorsement
  • Scrape, extract, copy, or compile store content for commercial use; or
  • Create derivative works from protected content.

Third-party names, marks, and content remain the property of their respective owners.

Section 11 - Reviews, Feedback, And User Content

If you submit a review, photograph, video, comment, suggestion, testimonial, or other content (“User Content”), you grant Varevo a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to host, reproduce, edit for formatting or length, publish, display, distribute, and use that User Content for operating, improving, and marketing the Services.

You retain ownership of your original User Content. You represent that:

  • You own or have permission to submit it
  • It is truthful and reflects your genuine experience
  • It does not violate another person’s intellectual property, privacy, publicity, or other rights
  • It does not contain unlawful, threatening, defamatory, obscene, deceptive, or malicious content; and
  • You have clearly disclosed any incentive, free product, discount, employment, family relationship, or other material connection associated with the review.

We may moderate, reject, remove, or decline to publish User Content that violates these Terms, appears fraudulent, is irrelevant, contains personal information, or is otherwise inappropriate. We do not promise to publish every review and will not alter a review merely to change its sentiment.

You may not submit a fake review, impersonate another person, misrepresent your experience, or use automated means to manipulate ratings or feedback.

Section 12 - Errors, Inaccuracies, And Availability

Information on the Services may occasionally contain typographical errors, inaccuracies, omissions, outdated information, or technical issues relating to product descriptions, images, pricing, promotions, shipping charges, delivery times, inventory, or availability.

We may correct or update information and, when legally permitted, cancel or modify an affected order. If we cancel an affected paid order, we will refund the canceled amount.

We do not guarantee that the Services will always be uninterrupted, secure, current, or error-free.

Section 13 - Prohibited Uses

You may use the Services only for lawful purposes. You must not use the Services to:

  • Violate any applicable law or the rights of another person
  • Engage in fraud, deception, harassment, abuse, or impersonation
  • Transmit malware, malicious code, spam, phishing messages, or unauthorized advertising
  • Interfere with the security, operation, or availability of the Services
  • Attempt unauthorized access to an account, system, or network
  • Collect personal information about others without authorization
  • Copy, scrape, extract, or exploit store content in violation of these Terms
  • Manipulate reviews, discounts, promotions, inventory, checkout, or payment systems
  • Place fraudulent orders or initiate abusive or bad-faith payment disputes; or
  • Use automated systems in a manner that imposes an unreasonable burden, bypasses access controls, or violates applicable instructions or law.

We may investigate suspected misuse and cooperate with payment providers, carriers, service providers, and lawful government requests.

Section 14 - Termination

We may suspend or terminate your access to the Services if you violate these Terms, misuse the Services, threaten security, engage in fraud, or create legal or operational risk.

Termination does not affect rights, payment obligations, claims, or provisions that arose before termination. Sections that by their nature should survive—including intellectual property, User Content licenses, warranty disclaimers, limitations of liability, indemnification, governing law, and dispute provisions—will survive.

Section 15 - Disclaimer Of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

Except for any express warranty stated by Varevo and any warranty or consumer protection that cannot legally be excluded, we disclaim implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, durability, and noninfringement.

We do not warrant that the website will always be uninterrupted, secure, or error-free, or that every product will meet subjective preferences or expectations.

This section does not exclude liability for fraud, intentional misconduct, personal injury caused by negligence where exclusion is prohibited, defective products where liability cannot be excluded, or any other responsibility that applicable law does not allow us to disclaim.

Section 16 - Limitation Of Liability

To the fullest extent permitted by applicable law, Varevo and its owners, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost revenue, lost savings, loss of data, or loss of business opportunity arising from or related to the Services or products.

To the fullest extent permitted by law, Varevo’s aggregate liability for a claim arising from a particular order will not exceed the amount you paid to Varevo for the product or order giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited, including liability for fraud, willful misconduct, or certain personal injury, consumer-protection, warranty, or product-liability claims.

Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, these provisions apply only to the maximum extent allowed by law.

Section 17 - Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Varevo, Shopify, and their respective owners, affiliates, employees, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal expenses arising from:

  • Your unlawful or unauthorized use of the Services
  • Your material breach of these Terms
  • Your violation of another person’s rights; or
  • User Content you submit.

This section does not require a consumer to indemnify Varevo for Varevo’s own negligence, unlawful conduct, defective products, or responsibilities that cannot legally be transferred.

Section 18 - Severability

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary. The remaining provisions will remain in effect.

Section 19 - Waiver And Entire Agreement

A failure to enforce a provision is not a waiver of that provision or any other right.

These Terms, together with the policies and any offer-specific terms incorporated by reference, constitute the entire agreement between you and Varevo concerning the Services and supersede prior communications concerning the same subject.

Any ambiguity will be interpreted fairly and in accordance with applicable law, rather than automatically for or against either party.

Section 20 - Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent.

We may assign or transfer these Terms in connection with a merger, acquisition, financing, sale of assets, restructuring, conversion to an LLC or corporation, or transfer of the business, provided that the assignment does not reduce nonwaivable consumer rights.

Section 21 - Governing Law And Disputes

These Terms and the Services are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

To the extent permitted by applicable law, legal proceedings relating to these Terms or the Services must be brought in the state or federal courts serving Wake County, North Carolina, and the parties consent to the jurisdiction of those courts.

Before filing a legal claim, you and Varevo agree to make a good-faith effort to resolve the dispute by contacting the other party and providing a reasonable description of the issue and requested resolution.

Nothing in this section prevents either party from bringing an eligible claim in small claims court or seeking urgent injunctive relief. Nothing in this section deprives a consumer of rights, protections, or a lawful forum that cannot be waived under applicable law.

Section 22 - Changes To The Services Or Terms

We may update the Services and these Terms from time to time.

When required by law, we will provide notice of material changes. Changes become effective on the date stated in the updated Terms or notice. Changes will not retroactively reduce rights relating to an order already completed unless permitted by law.

Your continued use of the Services after an updated version becomes effective constitutes acceptance of the updated Terms.
